South Carolina House unanimously passes bill to provide clear itemized billing for all healthcare services

By a vote of 107-0, the South Carolina housed passed H-4622 which will ensure all South Carolina hospital and medical care patients receive a clearly written, itemized bill of their healthcare services.

With approval from the Governor, the act will go into affect beginning January 1, 2025.

Details of the Bill

TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING SECTION 44-7-327 SO AS TO ESTABLISH CERTAIN REQUIREMENTS PERTAINING TO ITEMIZED PATIENT BILLING FOR HEALTH CARE SERVICES AND SUPPLIES.

    Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1.  Article 3, Chapter 7, Title 44 of the S.C. Code is amended by adding:

    Section 44-7-327.  (A) For purposes of this section:

       (1) “Debt collection” means an action, conduct, or practice in collecting, or in soliciting for collection, consumer debts that are due or alleged to be due a creditor.

       (2) “Health care provider” means a hospital or ambulatory surgical facility as defined in S.C. Code Section 44-7-130.

       (3) “Health care service” means a service a health care provider provides to an individual to diagnose, prevent, treat, alleviate, cure, or heal a human health condition, illness, injury, or disease.

    (B)(1) Beginning January 1, 2025, a health care provider that requests payment from a patient after providing a health care service or related supply to the patient shall submit with the request a written, itemized bill of the alleged remittance sought for each service and supply provided to the patient during the patient’s visit to the health care provider.  The provider must submit the itemized bill no later than the thirtieth day after the provider receives a final payment on the provided service or supply from a third party.

       (2) The itemized bill must include:

           (a) a plain language description, in accordance with the most current billing reading level requirements and guidance provided by the Centers for Medicare and Medicaid Services, for each distinct health care service and quantity of supply the health care provider provided to the patient;

           (b) the amount the provider alleges is due from the patient for each service and supply provided to the patient; and

           (c) if the provider sought or is seeking reimbursement from a third party, any billing code submitted to the third party, and the patient’s responsibility amount due to the provider pursuant the third party insurer’s explanation of benefits. The third party insurer’s explanation of benefits shall set forth a specific explanation of the patient’s responsibility amount including, but not limited to, whether the amount is a deductible, coinsurance, or noncovered charges.

       (3) A health care provider may issue the itemized bill electronically, including through a patient portal on the provider’s Internet website.

       (4) A patient is entitled to obtain from the health care provider an itemized bill on request at any time after the itemized bill is initially issued under item (1).

       (5) A health care provider may not pursue debt collection against a patient for a provided health care service or supply unless the provider has complied with this section.

       (6) A collection agency is not liable under this section for billing inaccuracies provided by the health care provider.  If any inaccuracies are determined, the collection agency must cease collection activities and return the account back to the health care provider.

    (C) The appropriate licensing authority shall take disciplinary action against the provider for the violation as if the provider violated an applicable licensing law.

SECTION 2.  This act takes effect upon approval by the Governor.

Rebecca Brewton Motte courageously helped burn her home on the Congaree River, when General Marion forced the British to surrender Fort Motte.

An over 400-acre park in a fast-developing section of North Charleston through the highlands and wetlands of the Blue House Swamp. The park will be accessed through a series of boardwalks and other pedestrian friendly routes.

Ingleside Park will be a central public open space covering 440 acres. The historic grounds of Ingleside Plantation have been an open area for at least 300 years and will serve as a core area of the future park. This former rice plantation has extensive trails on ancient levees through the rice fields and along the Blue House canal through the bottomland forested spine of the tract with forested upland buffers. Readily-accessible sites like the ruins of Ingleside, the ancient Live Oaks along the row where slave homes once stood, and easy access to see wetland birds afford a unique opportunity in North Charleston to immerse one’s self in the setting of an historic Lowcountry plantation while within a walking distance of urban populations.

Passive use of the property will also include foot traffic from access points off public roads with sidewalks like Ingleside Boulevard. Multi-family housing and mixed-use developments are being built all throughout this region which will bring new residents looking for daily walking opportunities.

The tract also includes native forest habitats that provide opportunity for solitude and remoteness. The Weber/Ingleside development of residential neighborhoods, retails centers, and commercial/industrial space represent the economic growth and prosperity that the GAB intended the Greenbelt corridors to balance—an area for non-automobile transportation, outdoor recreation, protection of ecologically valuable landscapes. This landscape includes a larger corridor of protected space with Wannamaker County Park and Goose Creek Reservoir downstream.

Big things are happening at the old Naval Base in North Charleston. Here is the latest from the City of North Charleston.

North Charleston City Council approved contract agreements for the 50-acre riverfront development known as Battery Park. A partnership consisting of Jamestown, Weaver Capital Partners, and WECCO Development will assist the City in transforming the former Charleston Naval Complex into a vibrant, mixed-use district and regional destination that celebrates and amplifies the unique aspects of North Charleston.

The development, which is aligned to the City’s “Battery Park Master Plan,” will include over 1,400 residential units and a mix of commercial uses that support local and regional economic growth. It is designed to improve quality of life of area residents, foster more equitable and sustainable economic development, advance community health and wellness, encourage social cohesion, and build community.

As part of the agreement, the development team will target 15 percent Minority and Women Owned Business Enterprises (MWBE) contractor participation during the construction phase, establish a local apprenticeship program, and reserve 17 percent of the residential units as workforce housing for people earning less than 120 percent of the area’s median income.

The development plans for Battery Park will establish a series of residential, retail, office, entertainment spaces, and parks along the waterfront and include the construction of a new pavilion with a market hall, event space, and an active green fronting the water. Within the 50-acre site, approximately 23 acres will become public spaces, parks, and streets.

The development team selected for Battery Park is also developing a nearby site known as Navy Yard Charleston, which is projected to encompass approximately 3.5 million square feet of commercial and residential space and over 2,600 residential units across 85 acres, also part of the former naval base. The project includes the adaptive reuse of the historic brick “storehouse row” buildings, the base’s former power plant, and the Naval Hospital.

Work on the 4,100-ft project in Charleston, SC, with a movable center span, set to start in 2024

Superior Construction is expected to start work next year on a pedestrian swing bridge over the Ashley River in Charleston, S.C. If completed as planned in 2027, the 4,100-ft-long bridge—with a 225-ft-long cable-stayed center swing span for the passage of marine traffic—would rank as the first of its type in the U.S., according to Superior, the design-builder. 

Working with design partner Johnson, Mirmiran & Thompson, Superior expects to kick off design for the $72.6-million project in November, 2023. The anticipated groundbreaking, with at-grade tie-ins to existing infrastructure on each end of the project, is the second quarter of next year, says Richard Kirkman, Carolinas’ division manager at Superior. Work on the bridge itself would start later next year.

The bridge would connect downtown Charleston to the city’s West Ashley area. The plan is to build the movable span in the open position to minimize impacts to marine traffic. 

“We were challenged by the city to come up with a unique design,” says Kirkman, that included the horizontal cable-stayed movable span. “When you approach a design-build project, you try to approach it with an open mind, and think outside the box.”

The design was developed with engineer TranSystems, and its subcontractor COWI, he adds. That helped the team secure the contract from the city. 

According to a city website, the idea for the pedestrian bridge dates to an $18.1-million BUILD grant Charleston received in 2019. The city, county and the Medical University of South Carolina matched the grant to the tune of $4.6 million, for a total $22.7 million. 

The city’s initial cost projections of about $42 million were found to be insufficient as firms began to submit proposals, local media reported in September. City officials cited inflation and construction costs for the increase.

The design-build project will be funded by Charleston, Charleston County, the South Carolina Dept. of Transportation and the Federal Highway Administration. The bridge will be constructed with large-diameter drilled shaft foundations of 8 ft to 9 ft. 

Five connected longitudinal spans will traverse the river itself. This includes the cable-stayed center span, with its hydraulics for swinging, and four others constructed of traditional girders with cast deck spans. On other parts of the bridge, 34-ft-long spans will cross the marshy areas with a precast prestressed concrete box-slab design stacked transversely to create the riding and walking surface, Kirkman says—an approach that’s expected to speed design, fabrication and construction. 

The impetus for the bridge is safety. More than 63,000 cars cross the Ashley River every day on two parallel bridges with narrow sidewalks, which resulted in more than 100 pedestrian-related crashes from 2014-19, according to a release from Superior. A key feature of the bridge will be a V-shaped pylon, while the bridge’s outward-leaning stay cable plane will reduce risk of ice on cables falling onto the pedestrian path.

Most of the bridge will be 15 ft wide, with tapering portions to expand to 24 ft for the five spans crossing the river. The scope of work also includes new movable bridge operations with CCTV monitors, a touchscreen display and discrete pushbuttons for the gates, as well as s trailhead with benches, water stations and bike repair stations.

Lowcountry Rapid Transit Receives $1.2 Million Attainable Housing Planning Grant for Phase 3 of Transit Oriented Development Study

North Charleston, SC – Lowcountry Rapid Transit (LCRT), a 21.3-mile bus rapid transit system and South Carolina’s first mass transit infrastructure project, has received a $1.2 million Federal Transit Administration grant to advance Transit Oriented Development (TOD) planning by focusing on implementation of affordable housing strategies in the project corridor.

Phase 3 of the LCRT TOD Study will develop a strategic affordable housing blueprint along the LCRT line. The study will feature station area site plans, zoning and policy progression, neighborhood plans, and community outreach and education.

“Planning work in Phase 3 of the LCRT TOD Study will align regional attainable housing initiatives with bike, pedestrian and transit infrastructure to support multimodal connectivity and provide residents safe access to transit stations by foot or bike,” said CARTA Chairman and Charleston City Councilmember Mike Seekings.

The study will enable mixed use development in station areas where multimodal infrastructure supports it, and Phase 3 will expand collaboration with both public and private sector partners. 

“LCRT is rapidly progressing and continues to enjoy the full support of the Federal government and local partners in its efforts to improve and connect our region,” said Berkeley-Charleston-Dorchester Council of Governments Executive Director Ron Mitchum. BCDCOG is the project’s sponsor agency.

Nearly all the grant funding comes from FTA’s Pilot Program for TOD planning, which provides resources to local communities to integrate land use and transportation planning into new fixed guideway or core capacity expansion projects.

The LCRT award is part of $17.6 million distributed to 20 projects in 16 states aimed at supporting community efforts to improve access to public transportation. The grants help organizations plan for transportation projects that connect communities and improve access to transit and affordable housing, per the FTA.

Phase 1 of the TOD study concluded that over half of the renters in the LCRT corridor are housing burdened, even more for low-income and minority populations, and set a target of 20% affordable housing units along the BRT line. Phase 2 TOD is advancing five strategies to support affordable housing implementation; however, as that work has advanced, more challenges and opportunities have been identified. Phase 3 will work to address this dynamic housing issue over an 18-month time period.

“LCRT is a historic opportunity to strengthen connectivity throughout our region, so working to increase citizens’ access to attainable housing throughout the project area just makes sense,” said Charleston County Council Chairman Herb Sass. “Put simply, this project is about more than transportation – it’s about enhancing quality of life for residents of Charleston County and beyond, and this is an important step in that direction.”

About Lowcountry Rapid Transit
The Lowcountry Rapid Transit (LCRT) project is a planned 21.3-mile Bus Rapid Transit project with over half of the line operating in center-running, dedicated bus lanes.  The project will serve 20 stations and 3 park & rides every 10 minutes during peak hours with 60′ battery electric buses, on-route charging and Transit Signal Priority (TSP).
